Terms and Conditions

By registering for the Work Alchemy Adventure and Coaching Mastermind Retreat on October 7-9, 2016 (the “Event”) conducted or organized by Jorch Consulting LLC (the “Organizer”), I (the “Participant”) hereby agree to these terms and conditions. I have been advised not to register for or attend the Event if I have objections to the following Terms and Conditions (the “Agreement”).

1. Event Admission

a. Admittance. Registration entitles Participant to entry to the Event, lunch both days and dinner one night. Any and all other costs associated with Participant’s attendance, including, without limitation, any travel, accommodation or meal expenses, will be Participant’s sol responsibility.

b. Termination. I acknowledge that Organizer reserves the right to prohibit my attendance at or request my removal from the Event if I fail to abide by this Agreement, or Organizer, in its sole discretion, considers my presence and/or behavior to create a disruption or to hinder the Event and/or the enjoyment of the Event by other attendees or speakers.

2. Registration Fees

a. Payment. Payment of the applicable fees for the Event is due in full in accordance with the payment plan I selected, and in any case, prior to admittance. If such payment is insufficient or declined for any reason, Organizer may refuse to admit me to the Event and will have no liability in that regard.

b. Taxes. The fees may be subject sales tax, value added tax, or any other taxes and duties that, if applicable, will be charged to me in addition to the fees.

3. Event Content

a. All intellectual property rights in and to the Event, the Event content, and all materials distributed at or in connection with the Event are owned by the Organizer, the Event sponsors or speakers presenting at the Event, as applicable. I may not use or reproduce or allow anyone to use or reproduce any trademarks appearing at the Event or in any copyrighted or otherwise proprietary information presented at or in connection with the Event without the prior written permission of the owner of the intellectual property.

4. Cancellations and Refunds

a. Requests for refunds must be made in writing via e-mail to info@WorkAlchemy.com.

b. Refund requests received before May 1, 2016 will receive a 100% refund minus a $150 administrative fee.

c. No refunds will be given for cancellations requested within two weeks (14 days) prior to the first day of the Event or thereafter.

d. Refunds will be processed within 30 days of receipt of the written notice.

5. Accident Waiver

I understand that, while every reasonable precaution has been taken to promote safety, not every situation can be controlled. Therefore, I ASSUME ALL OF THE RISKS OF PARTICIPATING IN THE EVENT and INDEMNIFY, HOLD HARMLESS, AND PROMISE NOT TO SUE the Organizer or persons mentioned in this document and release those parties from any and all liabilities or claims made as a result of my participation in the Event. This release includes, by way of example and not limitation, any risks that may arise from errors, omissions, acts, or failures to act on the part of the Organizer, any party or entity conducting a specific event or activity on behalf of the Organizer or from dangerous or defective equipment or property owned, maintained, or controlled by the Organizer or any party or entity conducting a specific event or activity on behalf of the Organizer.

Under no circumstances will Organizer be held liable for my injury, illness or death or any loss or damage of my personal belongings resulting from my participation in the Event or during my travels to and from the Event. Should I require emergency medical treatment as a result of accident and illness arising during my attendance and participation in the Event, I consent to such treatment. I acknowledge and I agree to be financially responsible for any medical or legal bills that may be incurred as a result of emergency medical treatment. I will notify Organizer verbally and in writing if I am at any time injured prior to, during, or after the Event in my travels or attendance, or if I have medical conditions about which emergency medical personal should be informed; however, I understand that Organizer is not legally obligated to act on that information in any way or to provide any medical service whatsoever to me. I agree that if I have any medical or psychological conditions that may hamper me from fully and healthfully participating in the Event that I will notify the Organizer and that the Organizer retains the right to ask that I not participate in portions of or the entirety of the Event.

6. No Professional Advice Disclaimer

The information contained in or made available by the Organizer or any third party through the Event or their websites or services cannot replace or substitute for the services of trained professionals in any field, including, but not limited to, mental, financial, medical, psychological, or legal fields. Organizer does not offer any professional, personal, medical, financial or legal advice and none of the information contained in the Event should be confused as such advice. Neither Organizer, sponsors, speakers, partners, contractors or any affiliates will be liable for any direct, indirect, consequential, special, exemplary or other damages to the Participant or the Participant’s business, including economic loss, that may result from participation in the Event or from the use of, or the inability to use, the materials, information, or strategies communicated through the Event or any products or services provided pursuant to the Event.

7. Confidentiality

I understand that that certain information of a confidential nature may be disclosed by the Organizer, presenters or other participants during the Event, to include personal information, tools, processes, strategies, materials and other business trade secrets. I will not intentionally disclose this confidential information to any third party or use the confidential information for my own benefit without specific approval by the person or entity making the disclosure of confidential information to me.

8. Audio/Visual Release

By participating in the Event, I understand that portions of the Event may be recorded in video and audio and/or captured in still and/or digital photographs by the Organizer. I agree that the Organizer and its assigns have the right and permission to use such recordings and photographs for any purpose without further compensation, permission, or notification. Organizer owns all rights in any audio, video, and/or photograph captured during the Event.

9. Jurisdiction and Disputes

The laws of the State of North Carolina shall govern the validity of this Agreement, the construction of its terms, and the interpretation of the rights and duties of the parties to this Agreement. I agree that any dispute that arises out of or relates to this Agreement will be resolved via binding arbitration in the State of North Carolina in accordance with the policies set forth by the American Arbitration Association. If any of these Terms of use are found unlawful, void, or for any reason unenforceable, then that provision will be considered severable from the remaining terms of use, and will not affect the validity and enforceability of the remaining provisions.
